Terms & Conditions.
| 1. |
Booking
Before a booking can be accepted the booking form and a copy of the terms and conditions must be completed and signed by the designated party leader. The party leader must be 21 years or older and must take full responsibility for all payments and correspondence.
All bookings are taken solely at the owners discretion.
The booking deposit (amount
advised at time of booking) must be received within 7 days or your reservation may not be held.
The balance must be paid in full ten weeks before the arrival date (the due date of the final payment will be shown on our invoice). Failure to remit the final balance in line with these terms may result in loss of your dates and forfeit your booking deposit. Bookings less than 10 weeks in advance must pay the full amount due including the security deposit. The final balance must include the security deposit.
Rental Times are 4pm on the arrival date to 10am on the day of departure. If you require and earlier check in or check out, please contact us. We may allow earlier entry providing it is not a changeover day when previous guests are vacating the same day.

Cancellation
The client may cancel the holiday booked at any time after it has been confirmed.
If you need to cancel the booking the owners must be informed in writing. Cancellation prior to 10 weeks before the arrival date will result in loss of booking deposit only. Cancellation less than 10 weeks before the arrival date will result in total loss of rental charge unless we are able to re-let your reserved
week(s).
We reserve the right to cancel the booking if the balance of the holiday is not paid by the prescribed
time, or the villa is not
available for any reason.
Should we need to cancel the
booking, we will give as
much notice as possible and
where possible try to accommodate
you elsewhere.
In the event of cancellation the security deposit will be refunded. Please plan for these possibilities and acquire adequate insurance.

Insurance
All guests should be covered by travel insurance, which carries adequate protection against delays and cancellation. It must also carry adequate medical insurance for the USA.
Our insurance does not cover your personal possessions lost or damaged when on vacation, nor does it cover any costs you may incur if you have to cancel your booking. It is the responsibility of the party leader to ensure all guests on the booking form have adequate cover.

Accommodation
This property is fully licensed for short term rental and Florida State law declares that everyone occupying the house must be listed on the booking form. This includes small children and must be adhered to. Whilst the villa
has beds for more than 14 to allow for maximum
usage flexibility, the maximum occupation stated by Florida Law for this villa is 14 persons and this occupancy limit may not be exceeded.
The property may not be shared, sub-let or assigned to other persons. The party leader may be allowed to amend or add names on the booking form (provided the numbers are within the permitted limits) and they have written agreement from the owners before doing so. The party leaders name may not be changed. No amendments will be accepted after the arrival date.
The property will be available to clients after 4pm Florida time unless otherwise agreed. The property must be vacated by 10am Florida time on the day of departure unless otherwise agreed.

Owner Access
Access may be required by authorised personnel for maintenance or by the owners during your stay.

| 6. |
Smoking
The property is a NO SMOKING villa.
For the comfort and safety of all our guests SMOKING IS NOT ALLOWED inside the villa. Failure to comply with this clause will render this booking void and our management company have the right to evict your whole party from the home.
Smoking is ONLY permitted on the property when outside on the deck area but ashtrays must be used. Should any damage caused by cigarettes (including but not limited to cigarette and cigar burns) be found on any part of the property the appropriate charge would be deducted from the security deposit.
If the management company find any evidence of smoking inside the villa during your stay this will be regarded as a serious breach of contract and you will be evicted immediately. All monies paid will be forfeited and you will be liable for a deep clean fee. This will include but is not limited to, professional cleaning of all soft furnishings, linens, carpets etc as well as a "clean air" fee, to replace all air conditioning filters and de-odorizing costs.

Pets
NO PETS or ANIMALS are
allowed in the villa.
Should pets or animals be found on the property a
deep clean and carpet cleaning charge will be deducted from the security
deposit and you may be evicted
from the property. This condition is strictly enforced.

| 8. |
Complaints
In the unlikely event that you may experience any problems with the property in the first instance you should contact the management company who will do their best to assist you and remedy the matter as soon as is practically possible.
Should the problem remain unresolved, the owners should be notified as soon as possible. Please note we are 5 hours ahead of
Orlando in time. Complaints or problems reported after the departure date will not be accepted or considered.

Neighbourly Conduct
The guests should occupy the property in a responsible and dignified manner.
Please act in a courteous manner towards your neighbours who may be permanent residents and keep noise to a minimum during early mornings and late evenings, particularly around the pool and patio areas. Excessive noise may result in a visit from the on site security or even the local Sheriff. This could lead to your party being excluded from the property without refund.

Security
Guests are expected to take all reasonable security precautions, including locking all doors and windows
and activating the alarm whenever they leave the property.
Failure to secure the property
may result in loss of security
deposit.

| 11. |
Construction Works
The property is situated on a
development where construction
is ongoing.
The development may also consist
of residential and vacation
homes. Therefore, the owners and
the Management Company cannot be
held responsible for any ongoing
construction, alterations to
existing houses or any noise as
a result thereof on or around
the resort.

| 12. |
Security deposit
A security deposit is required.
The amount of the deposit will
be shown on the booking form.
The deposit will be returned to the party leader when we have received confirmation from our management company that the property and all its fixtures and fittings are in the same condition as when you arrived, the contents are intact and that you arrived and vacated the property within the agreed times and dates. This is usually within 14 days of your departure.
Any breakages must be notified to our management company as soon as possible. To protect yourself from possible charges against your security deposit please inspect all rooms, including the pool and patio area immediately upon your arrival and let the management company know of anything that might be construed as damage (e.g., burns on counters, furniture or carpet; torn screens; major stains on carpet or walls; stained or torn upholstery; etc.) Should any damage exceed the value of the security deposit, the client is responsible for the costs of repair or replacement to remedy any damaged or missing items.

Pool Heating
If pool heating is required there is an additional charge. The owners cannot guarantee the temperature of the pool as this will vary according to different factors, mainly the prevailing weather.
We recommend pool heat between October and May.
If you require pool heat please order it at time of booking wherever possible as the heating of the pool takes time (we will normally turn on the pool heat a few days before you arrive). Guests may not interfere with the pool heating controls but contact our management company if problems arise. Any departures from this may result in loss of security deposit.

Your Booking
Changes in fees (including
fuel costs, taxes and exchange
rates) and services mean that
the price of your booking may
change after you have paid your
deposit.
We will absorb and you will
not be charged for any increase
equivalent to 5% of the price of
your booking. We reserve the
right to charge for any amount
over and above the 5%. If this
means that you have to pay an
increased amount for your
booking you will have the option
of accepting the new charge or
cancelling and receiving a full
refund of monies paid. The
price of your booking will not
change once the final balance
has been paid.

Passports
All guests from outside the USA must possess a full machine readable passport and any visas required for entry to the USA. It is the responsibility of the party leader to ensure that all guests have the correct travel documents, if there is any doubt please contact the UK or US embassy or passport agency for guidance.

Liability
The owners and their management company accept no responsibility whatsoever for death, personal injury, accidents, loss or damage to persons belongings however caused. The use of the accommodation and all amenities including the pool and spa and resort amenities are at the users own risk.
Children must be supervised at all times by a responsible adult, ESPECIALLY WHEN USING THE POOL AREA and at no time at all are the pool and deck door alarms to be tampered with. GLASS is not permitted within the pool area. Bicycles and other items provided are used entirely at your own risk.
We cannot accept liability for acts or omissions or of changes of third parties, such as Airlines, Car Hire companies etc. We can neither accept responsibility or liability for any accident, injury or illness sustained during your rental period, regardless of how it may occur. We cannot accept responsibility or liability for BellaVida resort services or amenities that are not available during your stay for any reason.

Telephone The 'land
line' telephone in the home is
provided as a service. Due
to the nature of the service we
cannot guarantee 100%
availability uptime, but
will endeavour to have any
issues reported with the service
resolved as quickly as possible.
In the event of an emergency,
the 'land line' (phones are located in the
kitchen and master bedroom)
and/or the alarm control box can
be used to contact the emergency
services.
The 'land line' telephone can
also be used to make free local
and toll free calls. The
'internet' phone where available
is provided on a trial basis and
may be withdrawn without notice.
The internet phone allows guests
to make long distance and
international phone calls,
subject to a fair usage policy
of up
to 250 minutes of inclusive
calls per week to landline
phones in the USA, Canada, UK,
France, Germany and Australia.
Calls to mobile and premium rate
numbers, or calls
outside of the inclusive minutes
per week are not included in the
free call allowance. The
cost of any calls made to mobile
or premium rate numbers, or
calls in excess of the inclusive
minutes may be deducted from the
guests security deposit. If you
anticipate making a large number
of calls we recommend you let us
know so we can ensure their is
sufficient credit on the
internet phone
to cover your anticipated usage. Should you exceed the fair usage
allowance the internet phone service
may be interrupted until the
automatic top up takes place.

Villa Computer / Internet Access
The computer and internet service
at the villa and clubhouse are
provided as a service.
Due to the nature of the
service, we cannot guarantee
100% availability 'uptime'. All
users of the computer or Wi-Fi
internet access agree to and
must comply with the Acceptable
Use Policy (AUP).
We do not exercise editorial
control or review over the
content of any Web site,
electronic mail transmission,
newsgroup, or other material
created or accessible over or
through the internet service. We
may remove, block, filter, or
restrict by any means any
materials that, in the property
owners sole discretion may be
illegal or violate this AUP.
The property owners may
cooperate with legal authorities
and/or third parties in the
investigation of any suspected
or alleged crime or civil wrong.
The following constitute
violations of this AUP:
This list is intended to be
illustrative and not exhaustive.
- Illegal use: Using the
Services to transmit any
material (by email,
uploading, posting, or
otherwise) that,
intentionally or
unintentionally, violates
any applicable local, state,
national or international
law.
- Harm to minors: Using
the Services to harm, or
attempt to harm, minors in
any way.
- Threats: Using the
Services to transmit any
threatening.
- Harassment: Using the
Services to transmit any
material that harasses
another.
- Fraudulent activity:
Using the Services to make
fraudulent offers.
Forgery or impersonation:
Adding, removing or
modifying identifying
network, message, or article
header information in an
effort to deceive or mislead
is prohibited.
- Unsolicited commercial
email/Unsolicited bulk
email: Using the services to
transmit any unsolicited
commercial email or
unsolicited bulk email.
- Unauthorized access:
Using the Services to
access, or to attempt to
access, the accounts of
others.
- Copyright or trademark
infringement: Using the
services to transmit any
material that infringes any
copyright, trademark,
patent, trade secret, or
other proprietary rights of
any third party, including,
but not limited to, the
unauthorized copying of
copyrighted material, the
digitization and
distribution of photographs
from magazines, books, or
other copyrighted sources,
and the unauthorized
transmittal of copyrighted
software.
- Collection of personal
data: Using the Services to
collect, or attempt to
collect, personal
information about third
parties without their
knowledge or consent.

Force Majeure
As with any other holiday, there are circumstances completely beyond our control, in which the property may not be available for your booking.
We cannot take any responsibility for, and shall not be liable in respect of loss or changes caused by force majeure. Examples of these circumstances (but not limited to) are destruction or severe damage to the property, strikes, fire, floor, closure of airports, weather conditions, war, riots, terrorist activity or any other event beyond our control.
In the event of "Force Majeure" prior to your arrival at the villa, the owners will do their best to make alternative arrangements for you where possible. If they cannot or if the alternative arrangements are unacceptable to you, then they will refund all monies paid to them. This will be the full extent of the owners liability in such circumstances and the owners cannot be responsible for any other costs connected with any such cancellation, however arising.
In the event of "Force Majeure" while you are at the villa (for example the airport being closed on your departure date) we recommend you contact your insurance company as soon as possible as they should be able to help you with alternate arrangements.
All advertised features,
including electronics and games
room equipment, are provided
subject to availability.
In the unlikely event a feature
is unavailable for any reason
(including but not limited to
breakdown or damage) please
notify the management company
immediately so they can arrange
repair or reinstatement of the
feature as soon as is reasonably possible.
This will be the full extent of
the owners liability in such
circumstances and the owners
cannot be responsible for any
other costs however arising.

| 20. |
Law
This contract is subject to and shall be construed in accordance with the laws of England and all parties hereby submit to the exclusive jurisdiction of the English courts.
THE SIGNING OF THE BOOKING FORM CONFIRMS THE ACCEPTANCE OF THE TERMS AND CONDITIONS SET OUT ABOVE AND SHALL BE BINDING ON ALL THE PERSONS INTENDING TO OCCUPY THE PROPERTY WHETHER OR NOT SUCH PERSONS HAVE SIGNED THE BOOKING FORM.

COMMERCIAL VEHICLES, CAMPERS, MOBILE HOMES, RECREATIONAL VEHICLES, MOTOR HOMES, HOUSE TRAILERS, BOATS ARE NOT BE PERMITTED TO BE PARKED OR TO BE STORED AT ANY PLACE ON PROPERTY. ALL VEHICLES MUST BE PARKED ON THE DRIVEWAY AND NOT ON THE ROAD.
